Terms and conditions

This is a translation for your convenience. If it differs from the Spanish version, the Spanish version prevails.
1. Who provides the service
Turnativo is a product of Rubén González López (trade name cyrks.), based in Spain. Contact: hola@turnativo.app.
2. The service
Turnativo Teams is a subscription that lets an organization plan its team’s shifts and share them with each worker through a subscribed calendar. The personal mode of the Turnativo app is free and is not covered by the subscription.
3. Free trial
Every new organization includes a full 14-day trial with no card required. When it ends, editing (creating and changing shifts) is paused until a subscription is activated. Workers keep access to schedules that have already been published.
4. Pricing and billing
Current prices for each worker tier are shown at turnativo.app. On the web, prices exclude VAT: the applicable tax is added at checkout. Payments are processed securely by Stripe, which asks for your company’s tax details (name, address and tax ID or VAT number) and emails you the invoice for each period. If you subscribe in the app, Apple charges the subscription through the App Store, with taxes included in the price, and you manage it from your Apple account. Either way, subscriptions renew automatically at the end of each period (monthly or yearly) unless cancelled beforehand.
5. Cancellation and refunds
You can cancel at any time; the subscription stays active until the end of the period already paid and does not renew. For refund requests or other billing issues, write to hola@turnativo.app and we’ll resolve them case by case in line with the applicable consumer law.
6. Data and privacy
What data we process, why, with which providers and how to exercise your rights is explained in the privacy policy. Data is hosted in the European Union and we don’t sell it to third parties.
7. Data processing
When an organization enters its workers’ data into Turnativo, the organization is the controller of that data and Turnativo acts as a processor under Article 28 GDPR. By using team mode, the organization and Turnativo agree that:
- Subject and duration: Turnativo processes the data only to provide the service (planning shifts and distributing them to each worker) while the organization exists in Turnativo.
- Data and data subjects: workers’ identification and contact details (name and, if given, email, department and contract hours) and their schedules, shifts, breaks and vacations.
- Instructions: the organization’s use of the service is its instructions; Turnativo doesn’t use the data for any other purpose.
- Confidentiality and security: only those who need it to provide the service can access the data, over encrypted connections with protected access.
- Sub-processors: the organization authorizes the providers listed in the privacy policy; we’ll give advance notice of any change, and the organization may object by cancelling the service.
- Assistance: we’ll help the organization handle workers’ rights requests and notify it without undue delay of any security breach affecting its data.
- End of processing: when the team or the account is deleted, the data is removed from the database right away and from backups within 30 days.
- Information: we’ll make available the reasonable information the organization needs to demonstrate compliance with this section.
8. Availability and changes
We work to keep the service continuously available, without guaranteeing any specific level of availability. We may update these terms; if a change is significant, we’ll announce it with reasonable notice through the service’s channels.
9. Governing law
These terms are governed by Spanish law, without prejudice to the consumer protection rules that apply in your country of residence.
